Andrea M. Hartung

Andrea earned her J.D. and graduated cum laude from the University of Florida Frederic G. Levin College of Law. She earned a B.A. in Political Science from Flagler College in St. Augustine, Florida and graduated magna cum laude.

Successfully defended Georgia EPD’s reissuance of three state-wide NPDES construction stormwater general permits from a third-party suit brought by the South River Watershed Alliance. The administrative law judge granted EPD’s motion to dismiss the Alliance’s claims. The Alliance appealed to the Fulton County superior court, where the judge upheld the dismissal. After opposing the Alliance’s discretionary appeal to the Georgia Court of Appeals, the court denied the application, thus upholding the stormwater permits and ensuring the continuation of state-wide construction.

Represented the State of Georgia in its defense of coastal marshlands ownership in quiet title actions brought by private parties. Including settlement of an ownership dispute over a 4,000-acre marshlands property.

Provided counsel to Georgia DNR in its settlement of fishing rights and preservation of the public’s right of way access on a portion of the Flint River known world-wide for its shoal bass fishing.

Successfully defended EPD’s issuance of a solid waste handling facility permit in Brantley County. After a multi-day evidentiary hearing and successive appeals, the Georgia Court of Appeals ultimately upheld the landfill permit.

Represented Georgia EPD in defense of dam safety reclassifications.

Provided counsel to Georgia EPD in defense of air quality permits for wood pellet facilities.
