DC Circuit Overturns EPA Superfund Listing of Polluted Indiana Site

Attorneys from Kazmarek Mowrey Cloud Laseter LLP were part of a team that recently obtained a significant victory in the D.C. Circuit. On Friday, May 18, the DC Circuit reversed the listing of an Indiana site with groundwater pollution on the federal Superfund list.  In its decision, the court found that the U.S. EPA ignored evidence that did not support its conclusions to justify listing the West Vermont Drinking Water Contamination Site in Indianapolis, Indiana. Genuine Parts Co. (represented by KMCL) and Aimco Michigan Meadows Holdings LLC filed the petitions with the DC Circuit requesting that the EPA’s listing of the site be reviewed.
